Terms of Service

Effective August 9, 2026

Please read these Terms of Service carefully. You agree to these terms upon providing payment for a commission, a service package, or any digital product I sell, and for any ongoing project-based services rendered.

I require and document any final agreement made between us for my own records, as a means to prevent scamming.

Part I - General Terms (all work)

1. Payment Structure

  • A minimum of 50% of the quoted total is due before any work begins. Your slot is reserved upon agreement; the initial payment is taken when I begin working on your commission.
  • The remaining balance is due before final delivery. Final deliverables (files, textures, packages) are released only after full payment is received.
  • I primarily take payment through PayPal, and can also accept Venmo, or Wise. Purchases through my website store are processed by Stripe at checkout.
  • Hard exclusions: no deferred payment, no revenue share, no "paid when it makes money" arrangements. No exceptions.

2. Decision Deadlines & Project Momentum

Timely feedback keeps your project on schedule. Delays in communication cause delays in delivery.

  • You have 5 business days to respond to review requests, progress updates, or decisions that require your input.
  • If no response is received within 5 business days: Your project will be placed on hold. Your slot in the queue is not guaranteed upon resumption. Re-activating a held project will incur a $75 USD re-activation fee.
  • After 30 days of no communication, the project is considered abandoned. The deposit is non-refundable, and I may decline to resume the project in the future based on current workload if contacted again.

3. Rush / Expedited Work

  • My standard turnaround is established at project start and documented in your quote.
  • Rush or expedited delivery - where you request completion faster than the quoted turnaround - is available at my discretion and is subject to a +50% to +100% surcharge on the total project cost, depending on the timeline requested.
  • Rush availability is not guaranteed and depends on my current workload.

4. Cancellation Policy

Cancellation by Client:

  • If you cancel after the concept phase - when further work such as retopology, texturing, or rigging has begun - all payments made up to that point are non-refundable.
  • The non-refundable deposit covers the time, skill, and labor already invested.

Cancellation by Me:

  • I reserve the right to cancel or decline a commission at any time.
  • If I cancel for reasons unrelated to client conduct, you will receive a full refund of all payments made.
  • If I cancel due to disrespectful, abusive, or boundary-violating behavior, I retain payment for all work completed and deliver the work done so far, per the Mutual Respect clause.

Mutual Respect:

  • I maintain professional and respectful communication with all clients. The same is expected in return.
  • Rude, demeaning, or abusive behavior - including mean-spirited insults disguised as "feedback" - constitutes grounds for immediate cancellation with payment retained for work completed.

5. Communication

  • Primary communication channels are X direct messages (@_RoyalMonarch3D), email ([email protected]), or any other mutually agreed upon means of communication.
  • I respond within 24 hours, Sunday through Saturday (Eastern Time).

6. Minors Policy

  • Clients must be 18 years or older.
  • Minors must have verifiable parental consent, with the parent or guardian acting as the paying party.
  • No exceptions.

7. Data Retention

  • Completed project files and assets are kept on my storage devices for a maximum of 1 month after final delivery.
  • After 1 month, I reserve the right to delete or archive project files. Once deleted, they cannot be recovered.
  • It is your responsibility to save and back up all deliverables, progress images, final assets, and reference files I send you during the project. Do not rely on me as permanent storage for your assets.
  • If you anticipate needing source files or revisions beyond the 1-month window, make arrangements with me in advance. Re-creation of deleted assets from scratch is billed as new work.

Part II - Custom Commissions

Applies to commissioned work built from scratch: custom clothing, armor, and accessories across any genre, full avatars, and environmental or world-building assets, across Second Life, VRChat, Unity, Unreal Engine 5, and Metahuman pipelines.

8. Scope Definition & Change Orders

  • The scope of work is defined in writing before any payment. Scope is locked once the deposit is paid.
  • A Scope Change is any request that goes beyond what was agreed upon, documented, and quoted at the start of the project. Scope Changes are not revisions - they are new work requiring a new agreement.
  • Scope Changes include (but are not limited to): changing to a different base avatar or body; adding new shapekeys, blendshapes, or morph targets; adding new meshes, clothing pieces, accessories, or props not in the original quote; replacing existing assets with completely different ones; changing the artistic direction after the concept phase is complete; any request requiring new modeling, new UV work, new texturing, or new rigging from scratch.
  • Upon receiving a Scope Change request, I will evaluate the effort required and provide a new quote. Work on the Scope Change does not begin until the quote is approved by you.
  • Scope Changes are billed separately from the original project and follow the same payment terms (50% upfront minimum). They do not consume or reset your included revision rounds - they are tracked independently.
  • I reserve the right to decline any Scope Change.

9. Revisions Policy

Revisions are minor adjustments to deliverables that fall within the scope of the original agreement. They are a courtesy - not an entitlement to unlimited changes.

Included Revisions:

  • 2 rounds of revisions are included per deliverable, at no additional cost for the first three hours per round of revisions.
  • A "round" is defined as: one set of consolidated feedback addressing all changes requested at that stage within a period of 3 hours. Feedback must be provided in a single, clear form of communication. Multiple separate messages across different days do not count and are prohibited.

What Qualifies as a Revision:

  • Color or material adjustments on existing textures.
  • Minor fit adjustments on existing rigged meshes.
  • Small weight paint corrections that do not require re-rigging.
  • Slight tweaks to an existing mesh's silhouette or proportion.

What Does NOT Qualify as a Revision (see Scope Changes):

  • Requesting a different base avatar or body.
  • Adding new shapekeys, new meshes, or new clothing pieces.
  • Replacing hair, ears, tail, or any accessory with a different asset.
  • Changing the design direction that was locked during the concept phase.
  • Any request requiring new modeling, new texturing, or new rigging from scratch.
  • Any work that was not clearly outlined or expressed upon the initial agreement and payment.

Beyond Included Revisions:

  • Each included round covers up to three hours of revision work. If revision work in the first or second round extends beyond three hours, the excess time is billed at the hourly rate documented in your quote, with a 1-hour minimum.
  • From a third round onward, no free period applies: all revision time is billed at the hourly rate documented in your quote, with a 1-hour minimum.
  • I will notify you before beginning any billable revision work. You must confirm and approve before work continues. Should approval not be attained, all work will halt until it is granted or the project is formally ended for any reason.

10. Paid Technical Discovery

This quote includes only the software, plugins, deliverables, and technical behaviors listed in the approved scope. Requests involving an untested addon, API, engine feature, export path, or workflow enter Paid Technical Discovery before implementation. Discovery is billed at $150 for up to two hours and evaluates feasibility, risks, and an implementation estimate. Discovery does not guarantee the requested result is achievable. Work pauses at the discovery cap until a revised scope is approved. Additional exploration is billed at $75 per hour in two-hour increments. You may approve the revised implementation, accept a documented workaround, or remove the feature from scope.

Features added after deposit require a written change order, which may include additional production hours, a 20-35% technical-risk premium, and a revised delivery date. No experimental implementation is included without written authorization.

11. Third-Party Asset Integration

Third-party assets (shaders, physics systems, lighting tools, addons) are quoted separately, per asset. A quote for an outfit, avatar, or other commission work does not include third-party asset integration unless the asset is explicitly listed in that quote.

For each third-party asset, your quote covers:

  • The purchase price of the asset itself.
  • The implementation labor: my time to study documentation, integrate the asset, and test it. Implementation labor is billed at $30 USD per hour for that asset.

You are quoted the total of both per asset, before work begins. Implementation time is not absorbed for free.

12. Intellectual Property

  • I will not redistribute an asset you have commissioned, provided you have paid in full for said asset, without your permission.
  • Assets purchased or commissioned from me do not automatically grant you ownership rights to redistribute them. This includes making the asset part of another model, asset, or merchandise, making the asset publicly available, or selling the asset. Contact me beforehand upon intention to redistribute or market the asset as part of another product or merchandise.
  • Full usage rights transfer upon final payment. Until then, all work remains my intellectual property.
  • I reserve the right to use commissioned work for portfolio and promotional purposes, including social media, my website, and my portfolio. You may request a 30-day delay on public posting (for a product launch or event reveal, for example); make this request before final delivery.
  • Commercial source-file rights, exclusivity, and buyout arrangements are available and priced in your quote.

13. Technical Limitations

  • You are responsible for verifying platform compatibility for your use case (VRChat version, Unity version, Second Life upload limits, Unreal Engine 5 targets).
  • I am not liable for platform updates that affect asset functionality after delivery.
  • Bug fixes reported within 30 days of delivery are included free of charge. Bug fixes reported after 30 days are billable at the hourly rate documented in your quote.

Part III - Outfit Refitting & Rigging Service

Applies to the multi-base refitting and rigging service offered to clothing store owners, VTubers, and content creators, as described on the Asset Refitting service page.

14. Units and Scope of Service

  • One unit is one clothing asset fitted and rigged to one base. Refit and rigging only: engine setup, materials, and physics configuration are quoted separately.
  • Supported bases are listed on the service page and updated as support expands. Modified and fully custom bases are in scope; provide your fully rigged model files and the outfit can be fitted to them.
  • Each delivery is rigged and pose deformation tested against the bases it lists before handoff.

15. Packages and Founder Rates

  • Service packages, unit counts, turnaround windows, and pricing are documented on the service page and confirmed in your individual agreement.
  • Turnaround windows begin on receipt of complete, usable source files, not at purchase: Base 5-7 business days, Studio 5-7 business days, Label 7-14 business days, Production 14-21 business days.
  • Unused units do not accumulate and do not roll over into the next month.
  • Submissions beyond a package's monthly allotment are not accepted at this time. Expanding an allotment requires moving to a higher package or a separate agreement.
  • Founder rates apply only to clients holding a founder slot. Once all founder slots are filled, list prices apply to new agreements. Founder rates already agreed are honored for the term documented in the agreement.

16. Commercial License (Refitting and Rigging Service Clients)

  • This license applies only to assets delivered under the Outfit Refitting and Rigging Service. Unlike private commissions (Section 12), assets delivered under this service are licensed for commercial use by design: you may sell and distribute the delivered refitted and rigged assets through your own store and catalog, on the platforms covered by your agreement. This license covers my refit and rigging labor on your own asset; it does not extend to products purchased from my stores, which are governed by Section 19.
  • You warrant that you hold the rights to the source outfits and assets you submit for refitting. I claim no ownership of your source intellectual property, and you claim no ownership of my service process.
  • I retain the right to reference the engagement in portfolio and promotional materials, subject to any launch-timing embargo documented in your agreement.

17. Pilots

  • Pilot requests are reviewed by hand. Submission of a pilot request does not guarantee acceptance; accepted pilots are confirmed by email.
  • Pilot-specific pricing and terms are documented in the individual pilot agreement and supersede list pricing where they differ.

Part IV - Digital Store Purchases

Applies to finished digital products purchased through any of my official storefronts.

18. Official Channels and Refunds

  • No refunds for digital goods sold through the {Monarch} website store, Gumroad, Jinxxy, Fab, or the Second Life Marketplace. Support is available - reach out through X direct messages or email and I will work with you.
  • Purchases are valid only through my official storefronts: the {Monarch} website, Gumroad, Jinxxy, Fab, and the Second Life Marketplace ({Debonaire}). Assets obtained anywhere else are not supported and may not be legitimate.

19. Store Product License

  • Store products are licensed for use on your own avatars and projects. You may not claim my products as your own work, remove watermarks or attribution, or redistribute them, including sharing files, uploading them publicly, or reselling them.
  • Proper credit with a hyperlink to the storefront you purchased from is required when using purchased products within VRChat on other assets.
  • Standard store purchases are non-commercial. Commercial use of a store product (inclusion in a sold model, asset, or merchandise) requires purchasing that product's Commercial License where one is offered, or a prior written arrangement with me where one is not. Commercial Licenses are priced separately from standard versions.

20. Mature Content

  • Products marked 18+ are sold only to adults. By purchasing or revealing mature content on my website, you confirm you are 18 years or older and that adult content is legal in your jurisdiction.
  • Every character, model, and avatar depicted in my product imagery, portfolio, and promotional material is a fictional, computer-generated three-dimensional model. No real persons are depicted in any content on this site, and no product or service I offer involves real performers.
  • No asset I create depicts, or is designed to depict, minors in any mature or suggestive context. Any request for such content is refused without exception.
